Welcome to My Kundli AI. By accessing or using our website, mobile application, and services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and My Kundli AI, governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Indian Contract Act, 1872.

2. Description of Services

My Kundli AI provides AI-powered Vedic astrology services including:

• Birth chart (Kundli) generation and analysis
• Daily, weekly, and monthly horoscope predictions
• Compatibility matching (Kundli Milan) for marriage
• Career guidance based on astrological analysis
• AI-powered astrological consultations
• Dasha predictions and planetary transit analysis

4. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be a resident of India or have the legal capacity to enter into contracts under Indian law
• Provide accurate and complete registration information
• Have the authority to bind yourself to these Terms

If you are using our Services on behalf of a minor (for generating their birth chart), you represent that you are their legal guardian and consent to these Terms on their behalf.

5. User Account and Responsibilities

5.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate birth details for astrological calculations
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

5.2 Prohibited Activities

You agree NOT to:

• Use the Services for any illegal or unauthorized purpose
• Attempt to reverse engineer, hack, or disrupt our systems
• Share your account with others or create multiple accounts
• Use automated scripts or bots to access our Services
• Reproduce, distribute, or commercially exploit our content without permission
• Use our predictions to mislead or defraud others
• Impersonate any person or entity
• Post defamatory, obscene, or offensive content

6. Subscription and Payments

6.1 Pricing

Our Services are offered under free and premium subscription tiers. All prices are displayed in Indian Rupees (₹) and are inclusive of applicable GST as per Indian tax laws.

6.2 Payment Processing

Payments are processed securely through Razorpay, an RBI-authorized payment aggregator. By making a payment, you also agree to Razorpay's terms of service.

6.3 Subscription Terms

• Subscriptions are auto-renewed unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• No partial refunds for unused portions of a subscription period
• Price changes will be notified at least 7 days before the next billing cycle

6.4 Refund Policy

In accordance with the Consumer Protection (E-Commerce) Rules, 2020:

• Refund requests must be made within 7 days of purchase
• Refunds are processed within 5-7 business days to the original payment method
• Digital services already consumed are non-refundable
• Technical issues preventing service delivery will be resolved or refunded

7. Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to:

• Software, algorithms, and AI models
• Website design, graphics, and user interface
• Text, images, and multimedia content
• Trademarks, logos, and brand elements
• Astrological interpretations and generated reports

are owned by My Kundli AI or its licensors and are protected under Indian intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes only.

8. User-Generated Content

If you submit any content through our Services (questions, feedback, etc.):

• You retain ownership of your content
• You grant us a non-exclusive license to use, display, and process such content for providing Services
• You represent that you have the right to share such content
• We may use anonymized data to improve our AI models

9. Limitation of Liability

To the maximum extent permitted by Indian law:

• My Kundli AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services
• We are not responsible for any decisions you make based on astrological predictions
• Our total liability shall not exceed the amount paid by you for the Services in the preceding 12 months
• We do not guarantee the accuracy, completeness, or reliability of astrological predictions

Note: Nothing in these Terms excludes or limits liability that cannot be excluded under Indian law, including liability for fraud or gross negligence.

10. Indemnification

You agree to indemnify and hold harmless My Kundli AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through our Services

11. Modifications to Services

We reserve the right to:

• Modify, suspend, or discontinue any part of our Services at any time
• Update these Terms with reasonable notice (posted on our website)
• Change pricing with 7 days advance notice
• Limit service availability based on geography or other factors

Continued use of our Services after modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• You engage in fraudulent or illegal activities
• Required by law or government order
• Your continued use poses risk to our Services or other users
